Does deleting your AI chats really delete them?

Short answer: Not immediately, and not always. OpenAI and Anthropic say deleted chats are removed within 30 days, unless they must be kept for legal reasons. Gemini keeps human-reviewed chats for up to three years even after you delete them. A court ordered OpenAI to preserve deleted ChatGPT chats in 2025. And deleting chats once a dispute is likely can be punished as destroying evidence.
How long do AI companies keep deleted chats?

Can a court stop an AI company from deleting chats?
Yes. In May 2025, in the New York Times copyright case, a federal magistrate judge ordered OpenAI to preserve ChatGPT output logs that would otherwise be deleted, including deleted and temporary chats. That ongoing duty ended on September 26, 2025, but the logs already preserved were kept.
Can I get in trouble for deleting my AI chats?
Yes, if a lawsuit or investigation is already happening or reasonably expected. Under the federal rules, if electronic information that should have been preserved is lost because a party did not take reasonable steps, a court can order measures to cure the harm, and if the party intended to deprive the other side of it, the court can instruct the jury to presume it was unfavorable or even end the case.
What should I do instead?
- If a dispute is likely, keep what you have and tell your lawyer.
- From now on, keep the details of your legal matter out of general-purpose AI tools.
- Choose tools that do not keep your words at the AI provider and that encrypt what they store.
