Is it safe to ask ChatGPT legal questions?
By Nick Steiner, founder of Confidelio · Updated
Short answer: For general questions about how the law works, usually yes. For your own legal problem, be careful. Consumer AI chats are not privileged, they may be used to train models unless you opt out, some are read by human reviewers, and every major provider's policy allows disclosure in response to legal process. A 2026 federal ruling held a defendant's AI chats were not privileged.
What is the risk of asking an AI about my own legal problem?
The main risk is that what you type is not confidential in the legal sense. In United States v. Heppner, a federal court held that a defendant's chats with a consumer AI were not protected by attorney-client privilege, partly because the provider's privacy policy allowed it to disclose what users typed. Facts you give an AI about your case could be requested in discovery or obtained with a warrant.
A second risk is accuracy. AI tools can state the law wrongly or invent case citations, so anything you rely on should be checked against the actual statute or opinion.
How do ChatGPT, Claude, Gemini and Copilot handle your chats?
| Used for training by default? | Deleted chats | Human review | Disclosure for legal process | |
|---|---|---|---|---|
| ChatGPT | Yes, unless you opt out in Data Controls; Temporary Chats are not used | Removed within 30 days unless kept for legal or safety reasons | Authorized personnel may access content | Allowed if required by law |
| Claude | Your choice in Privacy Settings on consumer plans | Removed from back-end systems within 30 days | Flagged chats may be reviewed for safety | Allowed, including to law enforcement |
| Gemini | Yes while Keep Activity is on, which is the default | Kept up to 72 hours even with activity off; reviewed chats kept up to 3 years | Some chats are read by human reviewers | Allowed for legal process |
| Copilot | Yes unless you opt out (some users excluded) | History kept 18 months unless you delete it | Some chats are reviewed; no opt-out | Allowed, including content |
Does turning off training make my chats confidential?
No. Opting out of training changes whether your chats help improve the model. It does not stop the provider from storing them for a period, reviewing flagged conversations, or producing them in response to a subpoena or warrant.
What should I avoid typing into a general AI?
- Admissions about what you did or did not do in a dispute or investigation.
- Names, dates and details that identify the people in your case.
- Anything your lawyer told you in confidence. The Heppner court said typing privileged information into an AI waived the privilege over it.
What is a safer way to use AI for a legal matter?
Use a tool built for confidentiality: one that does not train on your words, keeps nothing at the AI provider, encrypts what it stores, and is designed with attorney-client privilege in mind. Read the privacy policy before you start, and tell your lawyer which tool you used.
Common questions
Is ChatGPT confidential for legal questions?
Not in the legal sense. OpenAI's policy allows disclosure when required by law, and no court has held consumer AI chats privileged.
Can I use AI to represent myself in court?
Many self-represented people use AI to research and draft. Check every citation, follow your court's rules on AI use, and keep in mind that your chats may not be confidential.
Does Temporary Chat in ChatGPT protect me?
Temporary Chats are not used for training and are deleted within 30 days unless OpenAI must keep them for legal or safety reasons. They are not privileged.
Confidelio is a legal research AI designed to keep your work under attorney-client privilege. Your cases are encrypted with a key only your password unlocks, the AI keeps nothing, and nothing you write trains a model.
